Service Level and Availability

Fees and Payment

Termination

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARK TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Indemnification

You agree to indemnify and hold harmless Ark Technologies and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of our services or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ark Technologies is registered, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.
